Terms of Service

Welcome to OfMe. These Terms govern your use of the OfMe app and services. By creating an account you agree to these Terms and to the OfMe Privacy Policy.
1. What OfMe is (and is not)
OfMe is a marketplace platform that connects people who want photographs taken ("customers") with independent photographers ("photographers"). OfMe is not a photography studio and does not employ photographers. Photographers are independent contractors who decide when to be available, which jobs to accept, and how far they will travel.
2. Accounts
You must be at least 18, provide accurate information, and keep your phone number current (it is your sign-in). You are responsible for activity on your account. One person per account; you may hold both customer and photographer roles.
3. Booking, pricing, and payment
- Sessions are sold as fixed-duration packages at the prices shown in the app. Prices are set by OfMe's servers at the moment of booking.
- Pro Camera sessions cost more and are provided on a photographer's own professional camera (see Section 7). This tier is not yet available to book.
- During the pilot period, bookings may be free of charge; when card payments launch, you authorize OfMe's payment processor to charge your selected payment method at booking, including any tip you add and any fees below.
- Tips are optional, go 100% to the photographer, and are non-refundable once the session is complete.
4. Cancellations
- Customers: free cancellation while we are still searching for a photographer. After a photographer has accepted, cancelling incurs a $5 fee.
- Photographers: cancelling an accepted job returns it to other photographers and delays when new jobs unlock for you. The delay is 1 hour for a first cancellation, and 24 hours if it is your second cancellation within 5 days. Three cancellations within 3 days also carries a warning that the account is at risk of probation. A cancelled job cannot be re-taken by the photographer who abandoned it.
- "Now" jobs a photographer accepts but does not begin within the app's stated window are automatically released to other photographers.
- OfMe may cancel a job for safety, fraud, or operational reasons.
5. The session
The photographer travels to the customer's chosen location; live location is shared with the customer en route. Sessions can only start when the photographer is physically at the location (verified by the app). The session lasts the purchased duration and ends automatically; photo capture after the paid window is not accepted by our systems. Both parties agree to behave lawfully and respectfully. Customers must have the right to be photographed at the chosen location; photographers must comply with local rules at the location.
6. Photos: rights and OfMe's photo-privacy promise
- Delivery and rights. Photos taken during a session are delivered to the customer's private album. Upon delivery, the photographer assigns to the customer all rights, title, and interest in the session photos and waives any right to retain, use, publish, or exploit them.
- Photographer lockout. On standard sessions, OfMe's systems remove the photographer's access to the photos upon delivery and delete the in-app copies from their device. Photographers agree not to circumvent this, and doing so is grounds for permanent removal and legal action.
- Photo storage. OfMe stores delivered photos and their technical metadata on our servers to provide your album and operate the service, as described in the Privacy Policy. Users grant OfMe a license to store and use photos for those operational purposes. Photos are removed from our storage when you delete the photo, the album, or your account.
- Portfolios. Photographer portfolio images must be the photographer's own work with all necessary rights; session photos may never be used in a portfolio.
7. Pro Camera tier: special terms
- Pro Camera sessions are not yet available to book. When they launch, they are performed on the photographer's own professional camera at double the standard package price.
- Disclosure: the physical camera stores its own copies of the images, and OfMe cannot erase those. Customers must acknowledge this at booking. Photographers on Pro Camera sessions agree to delete all session images from their camera and any transfer devices after delivery and to never retain, use, or publish them (Section 6 applies equally).
- Photographers must pass OfMe's camera verification honestly; defeating the verification system is fraud and grounds for permanent removal and forfeiture of pending earnings.
8. Photographer earnings
Photographers earn 60% of the package price plus 100% of tips, credited after photo delivery. Payout processing is handled through our payout partner; onboarding there is required to receive funds.
9. Acceptable use
No unlawful, harassing, or deceptive conduct; no attempts to circumvent verification, photo lockout, pricing, or access controls; no scraping or reverse-engineering; no off-platform payment solicitation for booked sessions; no use of the service to photograph anyone who does not consent, or minors without their guardian's consent and presence.
10. Safety and content moderation
We may review chat messages, photos, ratings, and reports to enforce these Terms and protect users. Problems can be reported in-app via "Contact support." We may suspend or remove any account at our discretion for violations or safety risk.
11. Disclaimers and liability
OfMe provides the platform "as is." OfMe does not guarantee photographer availability, photo quality or artistic results, or uninterrupted service. To the maximum extent permitted by law, OfMe's total liability for any claim is limited to the greater of $100 or the amount you paid OfMe in the 6 months before the claim.
12. Changes; termination
We may update these Terms with notice in the app; continued use is acceptance. You may stop using OfMe at any time; account deletion is available via support. Sections that by nature survive (photo rights, liability) survive termination.
